Terms of Service – noremyahproductions

These Terms of Service (“Terms”) govern your access to and use of our Services. By using the Services, you agree to these Terms.

1. Bookings & Timeliness

1.1 Arrival Time

Clients must arrive on time and be ready at the scheduled start time.

1.2 Late Arrivals

Delays beyond 15 minutes may reduce coverage time or require rescheduling depending on availability.

2. Deposits & Payments

2.1 Deposit Requirement

A 50% deposit is required to secure your booking date/time.

2.2 Non-Refundable Deposit

Deposits are non-refundable unless we agree otherwise in writing.

3. Cancellation & Refund Policy

3.1 Cancellation Requests

To request cancellation, contact us at remypierre@noremyahproductions.com.

3.2 Refund Eligibility

Refunds of the remaining balance (if any) are only available if cancellation is requested at least 24 hours before the scheduled booking date, unless otherwise agreed in writing.

4. Digital Delivery, Download Window & Archiving

4.1 Delivery Method

We deliver photos/videos digitally (e.g., via download link, private gallery, or file delivery service).

4.2 Download Window

You have 30 days from the delivery date to download your files, unless a different period is stated in your invoice/contract.

4.3 Archiving

After the download window, your content may be archived. Archived projects may require a retrieval fee and may not be immediately available.

4.4 Client Responsibility

You are responsible for downloading and safely backing up your files within the download window.

5. Ownership & Usage Rights (Photos/Videos)

5.1 Ownership

Noremyah Productions LLC retains copyright and ownership of all photos/videos created, unless otherwise agreed in writing.

5.2 Client License (Personal Use)

Clients receive a non-exclusive license for personal use, including:

Sharing on personal social media
Printing for personal use
Personal portfolio/private galleries

5.3 Prohibited Uses Without Written Permission

The following are not allowed without written permission:

Selling, licensing, or commercial distribution
Use in paid advertising, brand promotions, or business marketing
Heavy modifications beyond basic cropping/color adjustments (unless approved)

6. Promotional Use by Noremyah Productions

6.1 Promotional Rights

Unless you request otherwise in writing before the event, Noremyah Productions may use selected photos/videos for promotional purposes (website, social media, portfolio, advertisements).

6.2 Opt-Out

If you want to opt out of promotional use, email remypierre@noremyahproductions.com before the event.

7. Taxes

Bookings may be subject to applicable taxes under Indiana law and other applicable regulations.

8. Liability

8.1 Service Interruptions

We are not responsible for interruptions or delays caused by weather, power failure, venue restrictions, equipment failure outside our control, or client delays.

8.2 Limitation of Liability

Our liability is limited to the amount paid for the service, to the extent permitted by law.

9. WhatsApp / SMS Terms (Customer Care)

9.1 Purpose

If you message us on WhatsApp or receive SMS updates, these messages are for support and service updates.

9.2 Frequency & Rates

Message frequency varies. Message and data rates may apply.

9.3 Stopping Messages

You can request to stop communications by contacting support@noremyahproductions.com or replying STOP where available.

10. Governing Law

These Terms and all services are governed by the laws of the State of Indiana, and disputes will be resolved in Indiana courts, unless otherwise required by law.
